General Conditions of Use

The purpose of these general conditions of use (hereinafter referred to as the "GCU") is to provide a legal framework for the provision of the https://geh.lanceuralertes.com/ website (hereinafter referred to as the "Site") and to define the conditions of access to and use of the services offered on the Site by the Internet user (hereinafter referred to as the "User").

The Host and Publisher of the Platform is PLUG'N'COM, whose registered office is at ZAE Wolser G.220- L3434 DUDELANGE (LUXEMBOURG).

These GCU are available on the Site in the General Terms of Use section.

ARTICLE 1: ACCEPTANCE OF TERMS OF USE

Access to and use of the Site are subject to acceptance of and compliance with these GCU.

The User is therefore advised to refer to the latest version of the GCU, which can be accessed at any time on the Site, before browsing. In the event of disagreement with the GCU, the User may not use the Site. 

ARTICLE 2: ACCESS TO THE SITE

The publisher uses the technical solutions at its disposal to allow access to the site 24 hours a day, 7 days a week. However, it may at any time suspend, restrict access to a given category of user or interrupt access to the Site or to certain pages thereof in order to update or modify its content or to take any other action deemed necessary for the proper operation of the Site.

It may also delete any information that could disrupt its operation or contravene national or international laws.

Connection to and browsing of this Site implies unreserved acceptance of these GCU, whatever the technical means of access and the terminals used.

The Site provides the User with free access to the following services:

  • Launch a professional alert ;

  • Follow a professional alert;

  • Dialog with the whistleblower's manager.

The Site is accessible free of charge from any location and to any User with Internet access.

All costs incurred by the User to access the services (computer hardware, software, internet connection, etc.) are the sole responsibility of the User. 

ARTICLE 3: RESTRICTIONS ON USE OF THE SITE

The publisher authorizes the User to access the Site for personal and non-commercial purposes. 

By accessing the Site, the User undertakes :

  • Not to use any mechanism, program or connected object that might interfere with the proper functioning of the Site;

  • To make reasonable use of the Site, avoiding untimely and abusive connections;

  • Not to copy, reproduce and/or distribute all or part of the content present on the Site;

  • Not to modify or block the content of the Site by any means.

ARTICLE 4: INTELLECTUAL PROPERTY

Any representation, reproduction and/or partial or total exploitation of protected intellectual property elements, of any nature whatsoever, is totally prohibited.

The User must request prior authorization from the holder of these rights for any reproduction, publication or copy of the various contents. The User undertakes to use the content of the Site in a strictly private context. Any use for commercial and/or advertising purposes is strictly forbidden.

Any total or partial representation of this Site by any process whatsoever without the express authorization of the publisher would constitute an infringement punishable by law.

Users who reproduce, copy or publish protected content must cite the author and source.

ARTICLE 5: MODIFICATION OF SITE CONTENT

The publisher reserves the right to modify, at any time and without prior notice, the Site, services and these GTC, in particular to adapt to changes in the Site by making new features available or deleting or modifying existing features.

ARTICLE 6: HYPERTEXT LINKS

The Site may contain hypertext links to other websites over which the Site has no control. Despite prior and regular checks carried out by the Editor, the latter declines all responsibility for the content that may be found on these sites.

The Publisher authorizes the creation of hypertext links to any page or document on its Site.

Excluded from this authorization are sites disseminating information of an illicit, violent, polemical, pornographic or xenophobic nature, or which may offend the sensibilities of a large number of people.

Lastly, this site reserves the right to remove any hypertext link pointing to it at any time, if it considers such a link to be in breach of its editorial policy.

ARTICLE 7 : COOKIES

The operation of a website often requires the use of cookies. These cookies are called "cookies".

7.2 : What cookies are being used?

These cookies are retained for twelve (12) months from acceptance of the cookie management policy.

The Publisher is only responsible for the content that it has published.

The Publisher shall not be held liable :

  • in the event of technical or IT problems or failures or the Site's compatibility with any hardware or software whatsoever ;

  • direct or indirect, material or immaterial, foreseeable or unforeseeable damage resulting from the use or difficulties in using the Website or its services;

  • the intrinsic characteristics of the Internet, in particular those relating to the lack of reliability and security of the information circulating on it;

  • illicit content or activities using the Site, without the Site having been duly informed of such content or activities within the meaning of the European General Data Protection Regulation (GDPR) on the protection of individuals with regard to the processing of personal data.

Furthermore, the Site cannot guarantee the accuracy, completeness or topicality of the information published on it.

ARTICLE 9: APPLICABLE LAW AND JURISDICTION

These GCU are governed by French law. In the event of a dispute and in the absence of an amicable agreement, the dispute will be brought before the French courts in accordance with the rules of jurisdiction in force.
